General Terms & Conditions


General Terms & Conditions (GT&C) of SCHILTHORN CABLEWAY LTD. (hereinafter SCHILTHORN CABLEWAY), legal operator of a boarding pass management system supplied by Inticket AG.

1. General


All deliveries and services of SCHILTHORN CABLEWAY, associated online orders as well as other online services are subject to these General Terms & Conditions (GT&C). Deviating and/or supplementary agreements require the express consent of the SCHILTHORN CABLEWAY management as well as the written form; this also applies to a waiver of the written form requirement.

2. Scope


In the case of online services, it must be noted that these are transmitted by SCHILTHORN CABLEWAY to the customer with a forgery-proof code. Since the customer can print out the service, multiple printouts are possible, of which only one is valid and redeemable. The first service redeemed via the boarding pass – ticket management system by Inticket AG with the corresponding code is regarded as the original and must be debited or invalidated immediately after redemption by SCHILTHORN CABLEWAY. Should further copies with an identical code emerge, this is considered an abuse of service which will have criminal consequences. There is no right of fulfilment and/or delivery or to compensation from SCHILTHORN CABLEWAY if someone attempts to redeem multiple vouchers with an identical code – even if the first holder to redeem the service is not the legal holder of the boarding pass or ticket. In fact, a criminal investigation (forgery of documents) may be launched immediately against any issuer with an intent to commit fraud.
Since a service can be transferred or gifted accordingly, there is no obligation or possibility on the part of SCHILTHORN CABLEWAY to verify the holder's right of ownership. When the service is redeemed, the system only checks whether the corresponding number has actually been released and whether the corresponding service has been paid for.
Boarding passes are generally valid for 1 day (see date and period of validity). After expiration of this time limit, SCHILTHORN CABLEWAY is no longer obliged to accept them. Lost boarding passes and tickets will not be replaced. Should SCHILTHORN CABLEWAY be forced to cease operations for any unknown reason, boarding passes and tickets will expire without right to reimbursement. This is also the case if there is evidence that the business is changing ownership. In such a case, SCHILTHORN CABLEWAY, as the original issuer of the service, cannot be held liable for fulfilment.

3. Payment


Payment can be made by credit or debit card only. If you choose to pay by credit card, the amount will be debited to your card immediately.

4. Right of Withdrawal


There is no right of withdrawal for boarding passes and tickets that are paid for and printed out online.

5. Defects


Complaints regarding non-fulfilment of service due to technical malfunction or closure of operations due to weather conditions must be submitted without delay to a SCHILTHORN CABLEWAY ticket counter. In the event a complaint is justified, SCHILTHORN CABLEWAY will either issue a refund or replace the boarding passes and tickets.

6. Data Protection


SCHILTHORN CABLEWAY is permitted to collect, store and process the personal customer data required in the context of the business relationship, taking into consideration the corresponding due diligence in the careful handling of customer data.

7. Final Provisions


The invalidity of individual provisions of these General Terms & Conditions (GT&C) shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a new provision which most closely resembles the economic effect and intent of the invalid provision. Place of performance and jurisdiction for contracts, including these General Terms & Conditions (GT&C), is Thun, Switzerland.
